Notice of Privacy Practices

Your rights

You have the right to:

• Inspect or obtain an electronic or paper copy of your medical record and other health information we maintain about you. We generally provide a copy or summary within 30 days and may charge a reasonable, cost-based fee.
• Ask us to correct health information you believe is incorrect or incomplete. If we deny the request, we will explain why in writing, generally within 60 days.
• Ask us to contact you in a specific way or at a different address. We will agree to reasonable requests.
• Ask us to limit how we use or disclose your information for treatment, payment, or health care operations. We are not always required to agree. If you pay in full out of pocket, you may ask us not to disclose that service to your health plan for payment or operations, and we will agree unless the law requires disclosure.
• Request an accounting of certain disclosures made during the six years before your request. One accounting in a 12-month period is free; a reasonable fee may apply to additional requests.
• Receive a paper copy of this notice at any time.
• Have an authorized personal representative exercise rights on your behalf after we verify that person's authority.
• File a privacy complaint without retaliation.

Your choices

You may tell us whether we may share information with family, close friends, or others involved in your care or payment for care. You may also tell us your preference about sharing in a disaster relief situation. If you cannot tell us your preference, we may share information when we believe it is in your best interest or when needed to lessen a serious and imminent threat to health or safety.

We will obtain your written authorization before using or disclosing your information for marketing, selling your information, or most disclosures of psychotherapy notes. Wellify Health does not sell patient information or conduct fundraising using patient information. You may revoke an authorization in writing at any time, except to the extent we already relied on it.

How we typically use and disclose information

Treatment

We may use your information and share it with other professionals involved in your care, such as a pharmacy, primary care clinician, therapist, laboratory, or specialist.

Health care operations

We may use and disclose information to operate the practice, improve care, train or supervise our workforce, conduct quality review, manage records, and contact you about appointments or services.

Payment

We may use and disclose information to bill you, submit claims, verify benefits, obtain payment, and respond to health plan reviews.

Other permitted or required uses and disclosures

We may use or disclose information when the law permits or requires it, subject to all applicable conditions and limits. These purposes may include:

• Public health and safety activities, including reporting adverse medication reactions, suspected abuse or neglect, and preventing or reducing a serious threat to health or safety.
• Health oversight, audits, licensing, investigations, and compliance reviews.
• Research that meets legal approval and privacy requirements.
• Workers' compensation claims and other legally authorized government functions.
• Responding to a court or administrative order, subpoena, law enforcement request, or other legal process when the applicable requirements are met.
• Working with a coroner, medical examiner, funeral director, or organ procurement organization when applicable.
• Complying with federal or state law and responding to the U.S. Department of Health and Human Services when it investigates our compliance.

Mental health and substance use disorder records

Federal and state laws may provide additional protection for mental health records, substance use disorder records, HIV-related information, genetic information, reproductive health information, and other sensitive information. When a more protective law applies, we will obtain your authorization before disclosure unless another law permits or requires the disclosure.

To the extent we maintain substance use disorder patient records subject to 42 C.F.R. Part 2, we will not use or disclose those records in a civil, criminal, administrative, or legislative investigation or proceeding against you without your written consent or a court order accompanied by a subpoena, as required by law.

Our responsibilities

• We are required by law to maintain the privacy and security of your protected health information.
• We will notify you as required if a breach may have compromised the privacy or security of your information.
• We must follow the duties and privacy practices described in the current notice and provide you a copy upon request.
• We will not use or disclose your information other than as described here unless you authorize us in writing or the law permits or requires it.

Changes to this notice

We may change this notice and make the revised terms apply to information we already maintain as well as information we receive in the future. The current notice will be available on this website, upon request, and at our in-person office.
